With all the accusations about Guantanamo, it seems that the trials are not the Kangaroo court everyone thinks. This person got a fair trial! The idea he deserves the same kind of civialian court as a citizen is not the issue. The issue is that the facts of the case would be deliberated by a jury. That jury deliberated and cleared him of some charges, and convicted him of others. Fair deliberation is what a trial is about, and he got it.

If this was a kangaroo court, they would have been back as quick as OJ Simpson never deliberating. They would have convicted him of everything if that was the case, but they didn;t. They judged his crime fairly, declared him guilty where he was guilty, and innocent where he was innocent.

What more do you expect?

Military jury convicts bin Laden's driver By MIKE MELIA, Associated Press Writer

GUANTANAMO BAY NAVAL BASE, Cuba - A jury of six military officers at Guantanamo Bay reached a split verdict Wednesday in the war crimes trial of a former driver for Osama bin Laden, clearing him of some charges but convicting him of others that could send him to prison for life.

The Pentagon-selected jury deliberated for about eight hours over three days before convicting Salim Hamdan of supporting terrorism. He was cleared of the conspiracy charge.

Hamdan, who faces a maximum life sentence, held his head in his hands and wept at the defense table after a Navy captain presiding over the jury read the sentence in a hilltop courtroom on this U.S. Navy base.

The judge scheduled a sentencing hearing for later Wednesday.

Defense lawyers had feared a guilty verdict was inevitable, saying the tribunal system's rules seemed designed to achieve convictions, said Navy Lt. Cmdr. Brian Mizer, Salim Hamdan's Pentagon-appointed attorney.

"I don't know if the panel can render fair what has already happened," Mizer told reporters as the jury deliberated.

Hamdan's attorneys said the judge allowed evidence that would not have been admitted by any civilian or military U.S. court, and that interrogations at the center of the government's case were tainted by coercive tactics, including sleep deprivation and solitary confinement.

Supporters of the tribunals said the Bush administration's system provided extraordinary due process rights for defendants.

"This military judge is to be commended for providing a fair and internationally legally sufficient trial for the accused and the government — regardless of the ultimate verdict," said Charles "Cully" Stimson, a former deputy assistant secretary of defense for detainee affairs.

Hamdan was captured at a roadblock in southern Afghanistan in November 2001 and taken to Guantanamo in May 2002.

The military accused him of transporting missiles for al-Qaida and helping bin Laden escape U.S. retribution following the Sept. 11 attacks by driving him around Afghanistan. Defense attorneys said he was merely a low-level bin Laden employee.

I guess we are trying to do our best. This conviction will show that no matter what part someone plays, they will be held accountable for their actions.

I'm curious, is this the same driver who said there were numerous chances to kill bin Laden prior to 9/11 that weren't taken advantage of?

Lets spend 5 years claiming this poor guy is a victim at Guantanamo, and will never get a fair trial, than after he does, just claim he wasn;t important anyway!

Let's spend 5 years and a buttload of taxpayer dollars in the name of safety and then end up less safe.

Bottom line, he was found guilty after a fair trial, and we are safer without him! He was found guilty of being a driver before 911, as well as weapons runner. Now today is giving an apology to the 911 victims before sentencing.

You are right Hansdew, it cost us a fortune. Justice is expensive and he is still alive to be sentenced. He is a lot better off than the 3000 people he helped kill.

Maybe some on you Guantanamo bashers, may end up with a little egg on your faces. If this isn;t a unbelievably lenient sentence and proof justice does exist at Guantanamo, I don't know what is.

All this talk about mass executions that would occur and no way for justice is disproven with this. His trial could have resulted in the death penalty, but was convicted for something they wanted 30 years for. Instead he was given 5 1/2 years, in which some of his sentence has been credited 5 yrs and 1 month served. He could be out in 5 months. He could be home before the end of the year.

I'd like to see who is big enough to admit, a fair trial and sentencing at Guantanamo, and this trial proove their prior statements wrong? Remember all the things you said Bush would do at Guantanamo?
Remember being convinced they would be executing them one after another.

Gitmo jury gives bin Laden driver 5 1/2 years 23 minutes ago

GUANTANAMO BAY NAVAL BASE, Cuba - A military jury gave Osama bin Laden's driver a stunningly lenient sentence on Thursday, making him eligible for release in just five months despite the prosecutors' request for a sentence tough enough to frighten terrorists around the globe.

Salim Hamdan's sentence of 5 1/2 years, including five years and a month already served at Guantanamo Bay, fell far short of the 30 years to life that prosecutors wanted. It now goes for mandatory review to a Pentagon official who can shorten the sentence but not extend it.

It remains unclear what will happen to Hamdan once his sentence is served, since the U.S. military has said it won't release anyone who still represents a threat. The judge, Navy Capt. Keith Allred, said Hamdan would likely be eligible for the same administrative review process as other prisoners.

Hamdan thanked the jurors for the sentence and repeated his apology for having served bin Laden.

"I would like to apologize one more time to all the members and I would like to thank you for what you have done for me," Hamdan told the panel of six U.S. military officers, hand-picked by the Pentagon for the first U.S. war crimes trial in a half century.

The military has not said where Hamdan will serve his sentence, but the commander of the detention center, Navy Rear Adm. David Thomas, said last week that convicted prisoners will be held apart from the general detainee population at the isolated U.S. military base in southeast Cuba.

"I hope the day comes that you return to your wife and daughters and your country, and you're able to be a provider, a father, and a husband in the best sense of all those terms," the judge told Hamdan.

Hamdan, dressed in a charcoal sports coat and white robe, responded: "God willing."
